This Privacy Notice establishes the terms and conditions under which SETALENT SOLUCIONES EMPRESARIALES S.C., hereinafter SETALENT, with its registered address located at: Montecito No. 38 28th Floor Office 16, Col. Nápoles, Deleg. Benito Juarez, CDMX, World Trade Center, will process the personal data of the Data Subject, in compliance with the Federal Law on the Protection of Personal Data Held by Individuals (the Law), and its regulations, making it known that: SETALENT protects and safeguards your personal data to prevent damage, distribution, commercialization, loss, destruction, theft, misplacement, alteration, and unauthorized processing.

I. WHAT INFORMATION DO WE COLLECT?

The personal data that you provide to SETALENT through the use of our services, in person, in writing, via email, or by any digital means, social networks, or specialized electronic portals for recruitment may include, but are not limited to: (i) identity data to prepare our service provision contract with our clients, such as: voter identification, articles of incorporation, power of attorney, proof of address, tax ID (ii) fiscal information for billing, including name, legal or trade name, address, email, tax ID number, (iii) banking information for payments to service providers: bank, account number, interbank CLABE account number, contact phone, branch or reference number, beneficiary’s name, (iv) contact information such as email addresses, phone numbers, address, name, and date of birth, (v) for applicants for positions, whether for our own vacancies or third parties, we request: name, resume, diplomas, certificates and/or proof of education, proof of address, birth certificate, marriage certificate, CURP, tax ID number, phone number, and (vi) for socio-economic studies of applicants for positions, we request: position applied for, personal data (home phone and cell phone, email, address, marital status, CURP, tax ID number, birth certificate, official photo identification), education proof, information about the candidate’s family and living environment (children, spouse, dependents, family members economically dependent on the candidate), information about the candidate’s housing, such as location, available services, type of housing (owned or rented), furniture and appliances, photographs of the candidate’s residence (interior and exterior), the candidate’s financial situation and closest family members, including the candidate’s credit information, identification data, general health status (based on questions to the interviewee), cultural aspects, and time management, work history, personal and professional references.

To ensure that the personal data provided is correct and current, SETALENT may collect information from other sources, such as personal, employment, and commercial references. For the purpose of signing our professional services contract, SETALENT may request a copy of your official photo identification, proof of address, and notarial testimonies such as articles of incorporation, powers of attorney, and certified copies issued by notaries and/or public brokers. The processing of personal data for third parties provided by you is carried out in accordance with the terms and conditions contained in the Privacy Notice. Only for the case of employee applicants, sensitive data may also be requested, such as academic, employment, and socio-economic information, which will be communicated to you and your consent will be requested for processing based on applicable legislation. You give your consent for the processing of your personal data in accordance with the terms and conditions of this Privacy Notice. Only in the event that the activity to be carried out is considered by the Federal Law for the Prevention and Identification of Operations with Illicitly Sourced Funds as a vulnerable activity, in addition to the aforementioned documents, identification data will also be requested to verify your identity and, where appropriate, that of third parties who are beneficiaries of the product and/or final service, as well as information about your activity or occupation, based on the registration and update notices presented for the purposes of the Federal Taxpayer Registry, information with which notices, reports, and documents regulated by said legislation will be submitted to the Ministry of Finance and Public Credit, for the purpose of compliance. This information will be safeguarded, stored, and protected in accordance with the provisions of the Federal Law for the Prevention and Identification of Operations with Illicitly Sourced Funds. In case of refusing to provide the information and/or documentation required by SETALENT, it will refrain, without any responsibility, from carrying out the relevant act or operation. The submission to the Ministry of Finance and Public Credit of Notices, information, and documentation referred to in the Federal Law for the Prevention and Identification of Operations with Illicitly Sourced Funds, by SETALENT in relation to its clients, users, or beneficiaries of the products and/or services provided to those who carry out Vulnerable Activities, will not imply any breach of confidentiality or legal, professional, tax, banking, fiduciary, or any other secrecy obligation established by law, nor may it be subject to a confidentiality clause in any agreement, contract, or legal act. The information and documentation that supports the Notices, as well as the identity of those who have submitted them, is considered confidential and of a reserved nature.

II. WHAT DO WE USE YOUR INFORMATION FOR?

The personal data we collect are intended for the provision of our personnel recruitment and training services, or, in the case of applicants for positions, to understand the profile they have for their own or third-party vacancies. Therefore, they may be used for the following purposes: i) Fulfillment of obligations arising from or related to any legal and/or commercial relationship we establish for the provision of our services requested by you, ii) Handling requests related to our services that you may be interested in, iii) Providing advice on personnel recruitment, headhunting, training, and human resources, iv) Informing about our current services, changes, and updates, v) Evaluating service quality, vi) Identifying service history, customer contact, and customer service, vii) Verifying the information you provide, viii) Fulfilling obligations contracted with you, ix) Billing and collection for our services, or xv) Including our personnel recruitment and selection processes, xvi) Integrating your file in case of hiring, xvii) Adding you to our database of electronic records for future vacancies, xviii) Understanding your profile as a candidate, xix) Integrating your file in case of hiring, and xx) changing or canceling the services you request. For the exclusive case of employee applicants, we process their data in order to carry out the recruitment, selection, and, where appropriate, hiring process, whether for our own vacancies or third parties. In the collection and processing of personal data, we comply with all the principles stipulated in the Law and its Regulations: legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility.

III. WHO DO WE SHARE YOUR INFORMATION WITH?

SETALENT may transfer your personal data to national or foreign third parties, such as tax, accounting, and legal advisors; promotion and marketing of our products and services; to fulfill obligations arising from a legal relationship between the data subject and SETALENT; and at the request of an authority. In this regard, SETALENT may contract one or more third parties as selected service providers to support consulting activities in personnel recruitment, human resources, accounting advice, fiscal advice, legal advice, promotion and marketing of our services.

IV. WHAT SECURITY AND CONTROL MEASURES DO WE USE TO PROTECT YOUR PERSONAL DATA?

SETALENT implements administrative, technical, and physical security measures to protect your personal data, which we require to be met by the service providers we hire, even for services provided by subsidiary or related companies. All information and personal data you provide through the use of our services, in writing, by email, or by any electronic means and/or by phone, will constitute a database owned by SETALENT. The information is stored for the purpose of protection against loss, misuse, disclosure, commercialization, or alteration. The protection of the privacy of personal data of minors is especially important to SETALENT. Therefore, when we have knowledge of personal data of minors, their treatment will be carried out in compliance at all times with the guidelines and requirements established in the Law and its Regulations. In case of a breach of our security measures, SETALENT will immediately inform the data subject so that the necessary measures can be taken, explaining what the breach consisted of.

 V. WHO IS RESPONSIBLE FOR THE MANAGEMENT AND ADMINISTRATION OF PERSONAL DATA?

VI. HOW CAN YOU LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA?

You can contact SETALENT if you wish to limit the use or disclosure of your personal data to stop receiving any type of information, such as service advertising or updates on the provision of our services. To do this, you can send a written request, meeting the minimum requirements specified in the following section, to the Privacy of Data department, via the email address ventas@setalentconsultoria.com.

SETALENT will retain the personal data of the data subject for the time necessary to process their requests for information, products, and/or services, as well as to maintain accounting, legal, financial, and auditing records in accordance with the Law and its regulations, as well as the current and applicable commercial, fiscal, and administrative legislation.

VII. HOW CAN YOU EXERCISE YOUR ARCO RIGHTS AND REVOKE GRANTED CONSENT?

As the data subject, you have the right to exercise your ARCO rights (access, rectification, cancellation, and objection to the processing of personal data), or revoke the consent you have given to SETALENT for the processing of your personal data. You can do this by submitting a written request directly to the "Privacy of Data" department via the email address

Alternatively, you can visit our offices in person or send a written request to the address located at Montecito No. 38, 28th Floor, Office 16, Col. Nápoles, Deleg. Benito Juarez, CDMX, World Trade Center. This written request must include at least (1) your name, (2) complete address and an email address authorized to receive the required information and notifications, (3) documents that prove your identity, clearly indicating your relationship with SETALENT, (4) clear and precise specifications regarding the personal data you are requesting access to, rectification, update, or cancellation of, (5) the elements or documents where the personal data may be found, and (6) stating the reasons why you want to access your personal data or why you believe your data should be updated, rectified, or canceled.

Upon receiving your request, the Privacy of Data department will have a period of 15 business days to respond. However, this period may be extended by an equal period, and you will be notified of the reasons for the extension, in accordance with Article 32 of the Law.

Additionally, you should be aware that according to the Law and its regulations, you can initiate the ARCO Rights Protection procedure with the Federal Institute of Access to Information and Data Protection (IFAI) within 15 days of the date when SETALENT responds to your request if the response is unsatisfactory, or if SETALENT fails to respond within the specified period.

We reserve the right to change or modify this Privacy Notice at any time. If there are any changes to this Privacy Notice, they will be communicated through SETALENT's website: www.setalentconsultoria.com and/or via email.

IX. CONSENT TO THE PROCESSING OF PERSONAL DATA

The data subject declares that they have read, understood, and agreed to the terms and conditions of the Privacy Notice provided, understanding the purpose of the collection and processing of their personal data, as well as the procedure for exercising their ARCO Rights. In the event that the collected personal data includes the provision of services by SETALENT through the corresponding contract, whether in print or electronic format, and their corresponding processes for obtaining consent, or in the case of applying for a job vacancy, you grant your consent to this Privacy Notice.

X. WHAT TRACKING TECHNOLOGIES DO WE USE ON OUR WEBSITE?
